These booking terms and conditions apply to all confirmed bookings created on or after the 1st day of January 2026 and supercede all previous versions.
Introduction and references
SevenReefPoint Ltd. is the owner of all properties listed on this site. The owner of the villa or unit that is being booked shall be referred to as “we”, “us” or “our” in these terms and conditions.
In addition the following definitions will be used in these terms and conditions
“Booking Term” means the dates you will be occupying the Property from the time of check in to the time of departure.
“Child or Children” means any person under the age of 18.
“Deposit” means the deposit that has been agreed to be paid at the time of the booking.
“Guest” means you and each person that will be staying with you in the Property on your booking (including children). For the avoidance of any doubt no person is permitted to stay in the Property unless they have been named in the booking.
“Property” means the property you have booked to stay in on your booking.
“Us” or “We” means the owner of the Property you have booked to stay in on your booking.
“You” means the lead person making a booking with us.
When you make a booking through us you are confirming that you and every Guest understands, agrees and accepts these terms and conditions. For any Guest who is a Child, the Child’s parent or legal guardian is confirming on behalf of that Child that the terms and conditions apply to the Childs’s stay in the Property.Please read these terms and conditions carefully, particularly clause headed “Limitation of Liabilities” and “Legal”
- Contract and Booking
When you make a booking you are entering in to a contract with us to occupy the Property.
- Condition and Use of the Property
The Property is provided in as marketed condition. We will use its best efforts to ensure the operation of all amenities in the Property, such as internet access, satellite or cable TV access or hot tubs, fireplaces as applicable.
However, we will not be responsible for such items’ failure to work, but will make every effort to correct any issues, once the You have reported them to us, as quickly as possible. The Guest acknowledges that use of amenities such as hot tubs, pools, spas, fireplaces, decks, and the like may be potentially dangerous and involve potential risks if improperly used, particularly regarding children and such use is at the Guest’s own risk.
You will ensure that you and every Guest will:
- use the Property only for residential purposes and in a careful manner so as to prevent any damage or loss to the Property;
- not to use the Property for any bachelor or bachelorette parties or any other party;
- In addition to refrain from playing loud music or activities which may disturb others, particularly during ‘quiet hours’ between 10pm and 8am when all noise is to be kept to a minimum;
- keep the Property in clean and sanitary condition at all times;
- act responsibly and carefully whilst at the Property, abiding by any Property specific house rules and leave the Property, and all things in or at it, in the same state of repair and cleanliness as at the start of the booking term;
- report to us any damage or breakages made during the booking term and pay for damage (wear and tear accepted);
- not smoke or vape at the Property nor allow anyone else to smoke or vape at the Property;
- not allow more than the maximum number of people or pets to stay at the Property as set out in the booking form;
- at all times comply with any applicable laws and local or Government guidance, and ensure that no Guest or their guests (if allowed at the Property) do anything which is illegal, or may cause unreasonable damage, noise, behaviour or disturbance;
- not to allow pets or other animals on the Property;
- not enter the Property before the stated arrival date and time and will leave the Property before the stated departure date and time;
- treat people with respect and not act in a way which is abusive, violent, destructive, menacing, or harassing towards us, any member of our team, any member of the community in which the Property is situated, or any of our employees, directors, consultants or other party acting on our behalf;
- secure the Property (including all windows and doors) whenever leaving the Property.
We will be entitled to make a reasonable charge where you or any Guest have failed to comply with these responsibilities unless you have breached the no smoking/vaping or no pets/animals rule in which case the cleaning fee set out at clause 13 will be payable.
Further, and in any event, in serious cases, you and any other Guest may have to leave the Property early without any compensation or refund and/or may result in legal action being taken by us to recover any loss or damage.
- Limitation of Liability
You, Guests and anyone invited by a Guest to the Property hereby voluntarily accept all risk of personal injury, death and/or property damage to Guest which occur on or about the premises during said term of occupation save in the event of proven negligence on our part.
If you or we fail to comply with these terms and conditions you or we will be liable (only) for losses which are a foreseeable consequence of the failure to comply with the applicable terms. Losses are foreseeable where they were contemplated by you and the Owner at the time you made the booking.
Nothing in these terms and conditions will limit our liability to you when it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence of the negligence of one of our employees, agents or subcontractors, or for fraud or fraudulent misrepresentation.
- Default
- If you or a Guest fails to comply with the conditions and obligations of these terms and conditions, you and all other Guests shall vacate the Property, remove all your property and belongings and leave the Property in good order and free of damage. No refund of any portion of the fees paid for the booking shall be made and, if any legal action is necessary, the prevailing party shall be entitled to reimbursement from the other party for all costs incurred.
- Assignment
You agree not to assign your booking, host parties/events at the Property or permit the use of any portion of the Property by any other person or person who is not a Guest and included within the number of and as permitted occupants under this Agreement
- Indemnification
You and any other Guest who is not a Child agrees to indemnify us for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any potential claim or litigation which may arise out of or in connection with Guest use and occupancy of the Property during the term of the booking.
- Entry and Inspection
We reserve the right to enter the Property on giving reasonable notice to you, and in an emergency without notice, for the purpose of maintenance repairs and inspection including, but not limited to any inspection by any Turks and Caicos Islands governmental department, agency or representative.
- Unavailability of the Property
In the event the Property is not available for use during the Booking Term due to reasons, events or circumstances beyond our control, we will use our reasonable endeavours to locate a replacement property that equals or exceeds the Property with respect to occupancy capacity, location and value that meets your reasonable satisfaction. If such replacement property cannot be found and made available, we shall immediately return all payments made by the Guest, whereupon the booking shall be terminated, and Guest and Owner shall have no further obligations or liabilities in any manner pertaining to this Agreement.
- Swimming pool
You and all other Guest understand, accept that we provide no lifeguard on the Property and you agree to inform all other Guests that there is no lifeguard on the Property. You further understand and acknowledge that said use of the pool is an inherently dangerous activity and assumes full responsibility for Guest own safety, and in particular the safety of any Guest who is a Child, during the Booking Term.
- Cancellation
In the you cancel sixty (60) days prior to the commencement of the Booking Term, the deposit amount is fully refundable minus applicable banking or credit card fees. If you cancel less than thirty (30) days prior to the commencement of the Booking Term, 50% of the deposit is refundable minus applicable banking or credit card fees. If you cancel less than seven (7) days prior to commencement of said term of lease, the entire deposit amount is forfeited.
Any cancellation or amendment request must be sent to us in writing via email and will take effect on the day we receive the request.
There will be no refunds any Guest voluntarily decides to leave the Property before the end of the Booking Term.
The purchase of travel insurance to cover delays and unexpected cancellations is recommended. You are encouraged to give consideration to the purchase of travel insurance as there are circumstances that can cause renters to cancel or interrupt their stay thereby forfeiting any non-refundable pre-payments or payments made for their trip.
- Termination of booking
In the event a Guest breaches any of these booking terms and conditions we reserve the right to remove you from the Property without prior notice and the booking will be cancelled. In such event no refund will be given to you or any Guest.
- Septic System
You understand and accept that septic systems at the Property use a natural bacterial process to break down waste. You therefore agree NOT to flush hygiene, personal care products & wipes down the toilets as these block the pipes and destroy the natural processes, which in turn can inconvenience other guests when systems block and overflow.
In the event that the septic system breaks down as a result of a Guest’s action the Property may become uninhabitable due to lack of sanitation for some or all of the remainder of the booking term. In that event the Guests will have to find alternative accommodation arrangements at their own expense and will be responsible for the cost of any required repairs or replacement of the septic system.
- Additional Cleaning fee
If any Guest or visitor smokes, vapes or allows pet or other animal on the Property you will be charged a cleaning fee of $1,000.00 (one thousand) US dollars plus fees on their credit card for breaching the no smoking/vaping and/or no pets/animals conditions.
- Security Deposit
We will agree with you the amount of security deposit that will be required prior to accepting your booking (the “Security Deposit”). The Security Deposit will be paid to Isle Help by credit care and held by them until the end of the Booking Term and will be refunded by them once they have received confirmation from us that all sums due to us arising from or in connection with the booking have been paid including, but not in any way limited to, payments for damage, lost keys or otherwise.
- ACKNOWLEDGEMENT and APPLICABLE LAW:
You and all Guests agree that we only operate our business in the Turks and Caicos Island and any booking is concluded in Turks and Caicos Islands.
Any dispute, claim or other matter which may arise in relation with your booking or Guest stay in the property will be governed by the laws of Turks and Caicos Islands and you and Guest agrees any dispute will be dealt with exclusively by the Courts of the Turks and Caicos. We or our designated agent may administer this agreement. If our agent administers this agreement you agreed that the booking terms apply to our agent in the same way as they apply to us.
I/we, the undersigned, hereby apply for the above listed accommodation and warrant that I/we have read, understand and agree to the terms and conditions of this application, and I/we agree to abide by homeowners/agents/association restrictions on use of said property. I/we further understand and represent that I/we are executing this application on behalf of all parties named as Guests.
I agree that this is a legally binding document and I have read all terms and conditions in this document.
